ОБЩИЕ УСЛОВИЯ ИСПОЛЬЗОВАНИЯ И СОТРУДНИЧЕСТВА

Дата вступления в силу: 1 сентября 2026 г.

1. Scope and Platform operator

These General Terms govern access to and use of JobsSerbia.com (the “Platform”), electronic conclusion of contracts, communications with users and the general rules applicable to services provided by HR Bulevar d.o.o. (“HR Bulevar”).

The Platform connects candidates, international recruitment partners/collaborators and employers in relation to employment, recruitment and administrative procedures connected with lawful residence and work in the Republic of Serbia.

Specific terms, service descriptions, specifications, estimates, commercial offers, invoices, cooperation agreements or other contractual documents may apply to individual services or categories of users.

Where specific terms apply to a particular service or user category, those specific terms supplement these General Terms. In the event of a conflict concerning a matter specifically regulated by the applicable specific terms, the specific terms shall prevail for that matter, subject always to mandatory applicable law.

In relationships with consumers, mandatory provisions of applicable law prevail over contractualprovisions.

These General Terms do not replace employment agreements, individual service specifications, Partner/B2B terms, Candidate terms or other documents that separately regulate a specific relationship with HR Bulevar.

2. User categories

For the purposes of these Terms, users of the Platform may include:

• Candidate – an individual seeking information, employment opportunities or administrative support relating to employment, Visa D, temporary residence, residence and work authorisation or other procedures connected with lawful residence and work in Serbia.

• International partner/collaborator – a recruitment agency, company, organisation, representative or other person acting in the course of a business or professional activity who submits candidates, cooperates in recruitment or uses partner services.

• Employer/user company – a legal entity, entrepreneur, company or organisation that advertises a vacancy, searches or uses the candidate database, reviews candidate profiles, selects candidates or otherwise engages HR Bulevar for recruitment or related services.

Certain services and contractual provisions apply only to a particular category of user.

If an individual purchases a service outside their business or professional activity and qualifies as a consumer, all statutory consumer rights apply regardless of the label assigned to the user category.

The classification of a user does not by itself determine whether a person is or is not a consumer; the nature and purpose of the particular transaction are relevant.

3. Services and legal nature

The Platform may provide information, receive applications, facilitate communication and coordination, process candidate submissions and provide employment, recruitment and administrative functionalities.

Depending on the relevant user category and service, the Platform and HR Bulevar may provide or facilitate:

• access to employment opportunities in Serbia;

• receipt and processing of candidate applications;

• processing and presentation of candidate profiles;

• access to a private foreign-worker database where applicable;

• presentation of candidate profiles to verified employers;

• publication of job advertisements;

• communication and coordination between candidates, partners and employers;

• administrative preparation of Visa D documentation;

• administrative preparation of temporary residence, Single Permit and/or residence and work-authorisation documentation;

• preparation, processing and translation of documents where included in the relevant service;

• application submission or submission support;

• communication and application-status support;

• partner services;

• employer and recruitment services;

• other related administrative or employment-support services.

The exact scope of each paid service is determined by the applicable service description, specification, estimate, specific terms, commercial offer, invoice, order confirmation or other contractual document.

Employment mediation and job placement for a candidate, where provided as employment services, are legally and commercially separate from the Visa D, Single Permit, temporary residence or other administrative service.

The paid administrative package fee relates exclusively to the administrative services identified in the applicable specification or contractual documentation and is not a price for obtaining, purchasing or guaranteeing a job.

Where HR Bulevar is the employer stated in the applicable employment documentation, the employment relationship and employment conditions are regulated separately by the relevant employment documentation and applicable employment law.

Job position, salary, working hours, accommodation conditions and other employment terms, where applicable, are determined by the relevant job offer, employment agreement or other employment documentation and not by these General Terms.

4. No guarantee of an authority’s decision

HR Bulevar makes reasonable efforts to prepare, process and administer applications professionally and in accordance with the information and documentation available to it.

However, HR Bulevar does not guarantee:

• approval of a Visa D application;

• approval of temporary residence;

• approval of a Single Permit or other residence and work authorisation;

• approval of any other administrative application;

• a particular processing time by a governmental authority;

• a particular procedure or appointment availability at an embassy or consulate;

• that an authority will not request additional documents or information.

The competent authority decides on the basis of applicable law, submitted documentation and the circumstances of the specific application.

All governmental and administrative decisions remain within the authority of the competent Serbian or foreign institution.

Payment for a service is consideration for the contracted administrative work and is not consideration for a positive governmental outcome.

A refusal, request for additional documentation, change in procedure or delay by a competent authority does not by itself mean that HR Bulevar failed to perform the contracted service.

5. Electronic contracting

Contracts and orders for services may be concluded electronically through the Platform or through another electronic method made available by HR Bulevar.

Before submitting an order, the user must be able, where applicable, to review and correct the information entered.

Before an order involving payment is submitted, the user must be clearly shown the information required by applicable law, including, where applicable:

• the subject matter and principal characteristics of the service;

• the identity and relevant contact details of the trader;

• the total price;

• all known mandatory additional costs;

• the method of payment;

• the method and expected time of performance;

• information relating to the right of withdrawal;

• applicable specific terms and key contractual conditions.

The function used to complete an order must unambiguously indicate that the order entails an obligation to pay.

Acceptance may be recorded through a checkbox, payment process or another appropriate electronic acceptance mechanism used during registration, application, purchase, candidate submission, partner onboarding, job-advertisement submission or another relevant process.

After the contract is concluded, HR Bulevar shall without delay provide an electronic order or contract confirmation on a durable medium where required by applicable law.

Such confirmation may include the applicable:

• pre-contractual information;

• service specification or estimate;

• order details;

• withdrawal information and withdrawal form where applicable;

• applicable specific terms;

• version of these General Terms accepted at the time of purchase.

HR Bulevar may retain electronic records evidencing the version of the applicable terms accepted, the date and time of acceptance, the relevant service or order and other information reasonably necessary to establish the contractual relationship.

Acceptance of these General Terms does not replace any separate consent, declaration, request or acknowledgement that must legally be obtained separately.

6. Price and payment

The applicable price for a service is displayed on the relevant Platform page and/or stated in the applicable specific terms, service specification, estimate, commercial offer, proforma invoice, invoice or order confirmation.

For a consumer, the applicable price is the price displayed immediately before the order is submitted and confirmed in the relevant contractual or commercial documentation.

All mandatory charges and costs included in the price must be identified as included.

Known costs that are not included in the price must be disclosed before the contract is concluded where disclosure is required by applicable law.

Costs that were not agreed or for which legally required consent was not obtained may not subsequently be charged to a consumer.

Unless expressly stated otherwise, separately described administrative procedures or services constitute separate services and payment for one service does not automatically include another subsequent service.

If advance payment is agreed, commencement of the service may be tied to:

• receipt of payment;

• delivery of required documentation;

• delivery of necessary information;

• completion of another requirement identified in the applicable specification or service conditions.

Applicable withdrawal, cancellation and refund rules are governed by mandatory law and, where relevant, the applicable Candidate Terms, Partner/B2B Terms or specific service conditions.

Payment for an administrative service does not guarantee candidate selection, employment or approval of a visa, residence or work-authorisation application.

For payments constituting retail turnover or an advance received, the appropriate fiscal receipt or other fiscal document shall be issued where required under applicable fiscalization rules.

7. Performance deadline

HR Bulevar’s deadline for performing the contracted administrative service shall be stated in the individual specification, order, service description or other applicable contractual documentation where required.

Unless otherwise agreed, the service shall be performed within the statutory period applicable to the relevant contract.

HR Bulevar’s performance deadline relates to the contractual obligations undertaken by HR Bulevar and does not include the period during which a governmental authority independently considers and decides an application.

Governmental or third-party processing periods may depend on:

• the competent authority;

• embassy or consulate procedures;

• the candidate;

• completeness and validity of documentation;

• requests for additional documents;

• employers or partners;

• banks, translators or other service providers;

• other circumstances outside HR Bulevar’s reasonable control.

The decision-making period of a government authority is therefore not HR Bulevar’s performance deadline.

Where performance depends on documentation, information, approval or cooperation from the user, a delay caused by failure to provide the required item may affect the expected time of performance.

HR Bulevar does not guarantee a particular governmental processing period unless expressly agreed otherwise in writing.

8. User obligations

All users are required to:

• provide accurate, complete, truthful, valid and authentic information and documents;

• keep material information supplied to HR Bulevar reasonably up to date;

• respond promptly to reasonable requests for additional documentation or information;

• verify personal data and the contents of documents before approving them for submission;

• immediately report material errors or incorrect information identified in submitted or prepared documentation;

• cooperate reasonably during the relevant recruitment or administrative procedure;

• comply with applicable laws;

• refrain from providing another person’s personal data without an appropriate legal basis or authorisation;

• refrain from supplying false, forged, misleading or altered documentation;

• refrain from interfering with the operation, functionality or security of the Platform;

• refrain from unauthorised access, scraping, harvesting, bulk extraction or other misuse of the Platform or its data.

Partners and collaborators must additionally ensure that candidate information submitted by them is accurate, relates to genuine and available candidates and has been collected and disclosed lawfully.

Partners must promptly inform HR Bulevar where a submitted candidate withdraws or becomes unavailable and may not represent that employment, candidate selection or governmental approval is guaranteed.

Employers must provide accurate company and vacancy information, truthful job descriptions and lawful employment conditions and must use candidate information only for legitimate recruitment purposes.

Employers must promptly inform HR Bulevar if a vacancy is materially changed, filled, suspended or withdrawn.

Subject to applicable law and contractual obligations, HR Bulevar may suspend, reject, restrict or terminate an application, candidate profile, account, advertisement or service where information is materially incomplete, inaccurate, fraudulent, forged, misleading or unlawful.

9. Liability and third parties

HR Bulevar is responsible for the contracted service within the limits of applicable mandatory law, including where part of the contracted performance is entrusted to a third party and the law requires HR Bulevar to remain responsible.

Subject to applicable mandatory law, HR Bulevar is not responsible for consequences directly resulting from:

• decisions of Serbian or foreign governmental authorities;

• embassy or consular decisions or procedures;

• delays caused by governmental authorities;

• inaccurate, incomplete or misleading information supplied by a user;

• forged or invalid documentation supplied by a user;

• delays caused by the user;

• failure by the user to cooperate or provide required documentation;

• independent decisions made by employers;

• independent actions or representations made by international partners without HR Bulevar’s authorisation;

• circumstances beyond HR Bulevar’s reasonable control.

HR Bulevar is not responsible for independent fees, promises, representations or obligations undertaken by a Partner or other third party without written authorisation from HR Bulevar.

This clause does not exclude or limit liability that cannot lawfully be excluded or limited.

Nothing in this clause limits obligations expressly undertaken by HR Bulevar under the applicable service specification, specific terms, employment documentation or other written agreement.

10. Intellectual property and content

The Platform and its content, including its design, databases, texts, graphics, logos, trademarks, software, candidate-profile structure and other materials, are protected under applicable intellectual-property and related laws.

Access to or use of the Platform does not transfer ownership of intellectual-property rights to the user.

Except where expressly authorised by HR Bulevar or permitted by applicable law, the user does not acquire the right to:

• resell Platform content;

• reproduce or commercially exploit Platform materials;

• systematically or in bulk download Platform content;

• scrape, extract or harvest candidate or employer data;

• reproduce or republish a substantial part of the Platform database;

• use HR Bulevar or Jobs Serbia trademarks, logos or branding without authorisation;

• use Platform content outside the purpose for which access was granted.

Ordinary use of information and documents made available to a user for the purpose of the relevant application, recruitment or service remains permitted in accordance with their intended purpose.

11. Privacy and cookies

Processing of personal data is governed by the Jobs Serbia Privacy Policy and relevant processing notices.

The Privacy Policy forms part of the Platform’s transparency framework and should be read together with these General Terms where personal-data processing is relevant.

The applicable legal basis for processing depends on the purpose and circumstances of the particular processing and may include performance of a contract, taking steps at the request of the data subject, compliance with a legal obligation, legitimate interests, consent or another lawful basis available under applicable law.

Acceptance of these General Terms does not constitute blanket consent to all processing of personal data.

Consent for direct marketing, where required, is requested separately from acceptance of the contract and is not a condition of purchasing a service unless otherwise permitted by applicable law.

Where a Partner supplies Candidate personal data to HR Bulevar, the Partner must ensure that such data have been collected and disclosed lawfully and that the Candidate has received any privacy information that the Partner is legally required to provide.

Where HR Bulevar acts as an independent controller, HR Bulevar may separately provide the Candidate with its own applicable privacy information.

Non-essential cookies and similar technologies are activated only after the user makes the appropriate choice where consent or another affirmative choice is required under applicable law.

Users may review further information concerning personal-data processing, cookies and applicable rights in the relevant Privacy Policy and Cookie notice.

12. Complaints and disputes

A consumer may submit a complaint in accordance with the Complaints Policy and applicable law.

HR Bulevar shall receive, record, consider and respond to consumer complaints within applicable statutory deadlines.

The complaint procedure may require the consumer to provide information reasonably necessary to identify the relevant transaction, service and issue.

HR Bulevar participates in out-of-court consumer dispute resolution where required by applicable law.

Use or availability of an out-of-court dispute-resolution procedure does not deprive a consumer of the right to judicial protection.

Complaints relating to a particular Candidate, Partner/B2B or Employer service may also be subject to the applicable specific terms governing that service, provided that such terms do not restrict mandatory consumer rights.

13. Amendments to the terms

HR Bulevar may amend, update or modify these General Terms from time to time.

Updated versions shall be published on the Platform together with the applicable effective date.

Amendments apply to future use of the Platform and future contracts from the published effective date, unless applicable law permits otherwise.

A contract already concluded with a consumer may not be unilaterally amended to the consumer’s detriment contrary to mandatory rules.

For each electronic order, the version of these General Terms and any applicable specific terms in force at the time of acceptance shall be retained or otherwise capable of being identified in accordance with applicable requirements.

Publication of amended Terms does not by itself retroactively amend an existing consumer contract where such an amendment would be prohibited by mandatory law.

Continued use of non-contractual Platform functionalities following publication of amended Terms may be subject to the updated version.

14. Governing law

These General Terms and contractual relationships governed by them are subject to the law of the Republic of Serbia.

Where a user qualifies as a consumer, the application of Serbian law does not deprive that consumer of mandatory rights applicable to the specific relationship.

Jurisdiction in consumer disputes shall not be agreed or interpreted in a manner that unlawfully deprives the consumer of access to a competent court or another procedure available under mandatory law.

Nothing in these Terms prevents a consumer from using a statutory complaint procedure, competent public authority, applicable out-of-court dispute-resolution mechanism or judicial remedy where such right is provided by law.
