رازداری کا نوٹس - جہاں امیدوار کا ڈیٹا پارٹنر کے ذریعے فراہم کیا جاتا ہے

1. Purpose of this Notice

This Privacy Notice applies where HR Bulevar d.o.o., operating the Jobs Serbia platform, receives personal data relating to a candidate from an international recruitment agency, recruitment partner, collaborator, employer, referral partner, or another third party rather than directly from the candidate.

This Notice supplements the general Jobs Serbia Privacy Policy and explains how HR Bulevar processes personal data received indirectly.

2. Who is Responsible for the Data

HR Bulevar d.o.o., Šumatovačka 72, Vračar, Belgrade, Republic of Serbia, operates the Jobs Serbia platform.

Where HR Bulevar determines the purposes and means for which candidate personal data are processed, HR Bulevar acts as an independent data controller in relation to that processing.

The Partner that originally collects candidate data may act as a separate and independent controller in relation to its own collection and processing activities.

3. Obligations of the Partner Providing Candidate Data

Before providing candidate personal data to HR Bulevar, the Partner must ensure that:

  • the personal data have been collected lawfully;

  • the candidate has received all privacy information required under applicable data protection law;

  • an appropriate legal basis exists for collecting and disclosing the candidate's data to HR Bulevar;

  • the data provided are accurate and, where necessary, up to date;

  • the candidate has been informed that their data may be provided to HR Bulevar and processed in Serbia for recruitment, employment and, where applicable, immigration-related purposes;

  • only personal data necessary for the relevant recruitment or immigration process are disclosed.

The Partner must be able to demonstrate compliance with these requirements upon reasonable request by HR Bulevar.

HR Bulevar may refuse to process, restrict the processing of, or delete personal data where there are reasonable grounds to believe that the data were collected or disclosed unlawfully.

4. Source of the Personal Data

HR Bulevar may receive candidate personal data from:

  • licensed or authorised recruitment agencies;

  • Jobs Serbia international recruitment partners;

  • collaborators and referral partners;

  • Serbian or foreign employers involved in a recruitment process;

  • other persons or organisations authorised to represent or refer the candidate.

Where reasonably possible, HR Bulevar may inform the candidate of the specific Partner or other source from which their personal data were obtained.

  • establishing, exercising or defending legal claims where necessary.

Candidate information will not be used for purposes incompatible with those described above without an appropriate legal basis and, where required, additional notice to the candidate.

7. Legal Basis for Processing

Depending on the particular processing activity, HR Bulevar may process candidate personal data on one or more of the following legal bases:

  • the candidate's consent, where consent is appropriate and legally required;

  • processing necessary in order to take steps at the candidate's request before entering into a contract or for the performance of a contract;

  • compliance with legal obligations applicable to HR Bulevar;

  • HR Bulevar's or a third party's legitimate interests, provided that those interests are not overridden by the candidate's rights and freedoms.

Where special categories of personal data are processed, HR Bulevar will rely on an additional legal basis required by applicable law.

Serbian law expressly recognises consent, contractual/pre-contractual necessity, legal obligation and legitimate interest as distinct grounds for lawful processing.

8. Who May Receive Candidate Data

Where necessary for the relevant purpose, candidate personal data may be disclosed to:

  • verified employers in the Republic of Serbia;

  • competent ministries, police, immigration authorities and other public authorities;

  • diplomatic or consular authorities where relevant to the visa process;

  • authorised professional advisers or service providers supporting HR Bulevar;

  • other recipients where disclosure is required by law.

HR Bulevar does not sell candidate personal data.

Personal data will only be disclosed to recipients where there is an appropriate legal basis and the disclosure is relevant to the recruitment, employment, immigration or related administrative process.

9. International Transfers

Because Jobs Serbia works with candidates and recruitment partners located in different countries, personal data may be received from or, where necessary, transferred to recipients outside the Republic of Serbia.

Where applicable data protection law requires specific safeguards for an international transfer, HR Bulevar will ensure that an appropriate transfer mechanism or other lawful basis is used.

Where HR Bulevar intends to transfer personal data from Serbia to another country or international organisation, information concerning the applicable transfer safeguards will be provided where required by law.

10. How Long We Keep Candidate Data

Candidate personal data will be retained only for as long as reasonably necessary for the purposes for which they were collected, including recruitment, employment, immigration, legal, accounting and compliance purposes.

Retention periods may vary depending on:

  • whether the candidate proceeds with employment;

  • whether a visa, residence or Unified Permit procedure has been initiated;

  • applicable statutory retention requirements;

  • the need to establish, exercise or defend legal claims.

When personal data are no longer required, they will be deleted, anonymised or otherwise securely disposed of in accordance with applicable law and HR Bulevar's retention procedures.

  • object to certain processing based on legitimate interests;

  • request data portability where applicable;

  • withdraw consent at any time where processing is based on consent;

  • lodge a complaint with the Commissioner for Information of Public Importance and Personal Data Protection of the Republic of Serbia.

Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

12. Automated Decision-Making

HR Bulevar does not make decisions producing legal or similarly significant effects on candidates solely through automated processing or profiling.

Recruitment and employment decisions involve human review.

13. HR Bulevar's Independent Transparency Obligation

The fact that a Partner has already provided its own privacy notice to the candidate does not automatically remove HR Bulevar's obligations under applicable data protection law.

Where HR Bulevar receives candidate personal data indirectly and acts as a controller, HR Bulevar will provide the candidate with the information required by applicable law, unless a lawful exception applies.

As a general rule, where the data have not been obtained directly from the candidate, the relevant information will be provided within a reasonable period after receipt of the data and, where required, no later than the first communication with the candidate or the first disclosure of the data to another recipient.

14. Partner Responsibility and Cooperation

Partners must cooperate with HR Bulevar in responding to data protection requests, investigations, complaints or incidents relating to candidate data they have provided.

If a Partner becomes aware that:

  • candidate data were provided without an appropriate legal basis;

  • information provided was inaccurate;

  • a candidate has withdrawn consent where consent was relied upon;

  • a candidate has requested deletion, correction or restriction;

  • a personal data breach has occurred;

the Partner should inform HR Bulevar without undue delay.

Nothing in the contractual relationship between HR Bulevar and a Partner limits the statutory rights of candidates under applicable data protection law
