B2B PARTNER TERMS – INTERNATIONAL AGENCIES AND COLLABORATORS
These terms apply only where the Partner enters into the contract in the course of its business/professional activity. If a particular individual qualifies as a consumer, mandatory consumer rights cannot be excluded merely by applying this label.
1. Registration and fees
Partner registration, duration, registration fee and per-candidate fees are governed by the applicable offer/pro forma invoice and B2B agreement.
2. Nature of the fee
The Partner must not present HR Bulevar’s administrative fee to a candidate as a price for obtaining a job, a “guaranteed job fee” or a government fee. The Partner is independently responsible for its own fees and local legal obligations, but must not create a false impression that HR Bulevar requires a payment where that is not true.
3. Candidates and data
The Partner warrants that candidate data were collected lawfully, that the candidate was informed of disclosure to HR Bulevar, and that the Partner has an appropriate legal basis/authorization for the disclosure. The Partner shall not submit forged documents, unlawfully retain original passports, make false promises, or use coercion, deception or discrimination.
4. Accuracy of information
The Partner must accurately communicate to candidates information about the position, salary, costs, process, risks and the fact that the government authority decides on the visa/permit. It is prohibited to guarantee a visa or unconditional employment unless this is accurately established by binding documentation.
5. B2B payment and refund terms
B2B payment, cancellation and refund terms may be agreed separately in the offer/agreement, subject to mandatory law. B2B provisions should not be copied into Candidate Terms or used to restrict consumer rights.
6. Compliance
The Partner shall comply with employment, migration, advertising, data protection, anti-trafficking, anti-corruption and other applicable laws in its country and in the Republic of Serbia to the extent applicable to the Partner. HR Bulevar may suspend a Partner where there are reasonable indicators of fraud, coercion, unlawful charging or forgery.
7. Governing law and disputes
For the B2B relationship, the law of the Republic of Serbia and a competent court in Belgrade may be agreed, unless specific legislation or an individual contract provides otherwise.
